Whistleblower protection focus of new OSHA fact sheet

A new OSHA fact sheet (OSHA-3812) outlines employee rights and protections from retaliation when filing a whistleblower complaint. These rights and protections are guaranteed under section 11(c) of the Occupational Safety and Health (OSH) Act.

Under the Act, it’s illegal for an employer to retaliate against employees who exercise their right to file a safety and health complaint. Other protected actions include:

  • Raising safety and health concerns with their manager or employer;
  • Asking questions, expressing concerns, or requesting copies of safety data sheets;
  • Reporting work-related injuries or illnesses;
  • Requesting copies of OSHA standards or regulations; and
  • Participating in an OSHA inspection.

Employers may not take “adverse action” against an employee who exercises their rights under the OSH Act. Adverse actions include:

  • Firing or laying off;
  • Demoting;
  • Disciplining;
  • Intimidating, threatening, or harassing; or
  • Reducing hours or pay.

Employees or their representatives who believe they’ve been retaliated against must file complaints within 30 days after the alleged retaliation occurs.
