Michigan amends its Earned Sick Time Act (ESTA)

Effective date: February 21, 2025
This applies to: Employers in Michigan with one or more employees.
Description of change: The ESTA was amended in a variety of ways, including the following:
- The law no longer requires smaller employers to provide 32 hours of unpaid sick time.
- Employers may frontload the leave.
- Employers that frontload ESTA time need not carry over unused ESTA.
- Employer may use existing PTO or vacation time to satisfy their ESTA requirement, as long as that time can be used to take paid time off for all qualifying ESTA reasons.
- Employers must give employees a written ESTA notice by March 24, 2025, or upon hire, whichever is later.
- Employers with 11 or more employees must comply by February 21, 2025. Employers with 1 – 10 employees must comply by October 1, 2025.
