CA COVID supplemental paid leave is back – at least through September

On February 9, CA Governor Newsom signed a law resurrecting the state’s COVID-19 supplemental paid sick leave requiring employers with more than 25 employees to give employees up to a total of 80 hours of leave for virus-related reasons through September 30, 2022. Employers must provide the leave as of February 19, but the provision is retroactive to January 1.
Full-time covered employees may take up to 40 hours of leave if they are unable to work or telework because they are:
- Attending a vaccine or booster appointment for themselves or a family member.
- Subject to quarantine or isolation period related COVID-19.
- Caring for a family member who is subject to a COVID-19 quarantine or isolation period or are caring for a child whose school or place of care is closed or unavailable due to COVID-19 on the premises.
Full-time covered employees may take up to an additional 40 hours of leave if they are unable to work or telework because they:
- Test positive for COVID-19.
- Are caring for a family member who tested positive for COVID-19.
Part-time employees are entitled to an amount of leave depending on their schedule.
