Supreme Court halts COVID ETS

On January 13, the Supreme Court halted OSHA’s COVID-19 Emergency Temporary Standard (ETS), pending a possible review of the merits by the 6th Circuit. The Court stated that it agrees that the petitioners are likely to prevail in their argument that OSHA’s mandate exceeds its statutory authority and is unlawful.
On December 17, the Sixth Circuit Court of Appeals dissolved the stay against the ETS, requiring employers with 100 or more employees to comply with COVID-19 vaccination or testing options.
Several groups, including states, businesses, and nonprofit organizations, petitioned the Supreme Court to weigh in on the decision.
