OSHA’s Fall 2022 regulatory agenda shows what’s on agency’s radar

OSHA’s long-awaited Fall 2022 regulatory agenda was released January 4 and projects three “major” final rules for 2023: COVID-19 in healthcare settings, electronic submissions, and hazard communication. Most rulemakings are at the proposed rule stage, and when they come up in the Federal Register, stakeholders will have a chance to comment.
Final rules
The agency expects eight final rules in the coming months:
- December 2022 — Procedures for the Handling of Retaliation Complaints Under the Taxpayer First Act
- December 2022 (at OMB) — Occupational Exposure to COVID-19 in Healthcare Settings
- December 2022 — Procedures for the Handling of Retaliation Complaints under the Criminal Antitrust Anti-Retaliation Act
- January 2023 — Procedures for the Handling of Retaliation Complaints Under the Anti-Money Laundering Act
- February 2023 — Procedures for Handling of Retaliation Complaints Under the Whistleblower Protection Statutes
- March 2023 — Update to the Hazard Communication Standard
- March 2023 — Improve Tracking of Workplace Injuries and Illnesses
- June 2023 — Procedures for the Use of Administrative Subpoenas
