July EEO-1 deadline announced: Ready, set, report!

The Equal Employment Opportunity Commission (EEOC) has indicated that the 2022 EEO-1 Component 1 data collection is tentatively scheduled to open in mid-July 2023. It was originally expected to open in April.

All private sector employers with 100 or more employees, and federal contractors with 50 or more employees meeting certain criteria, must collect demographic workforce data, including data by race/ethnicity, sex, and job categories.

This information must then be collected on the EEO-1 Report (officially called the Employer Information Report EEO-1) and filed annually with the EEOC’s Office of Enterprise Data and Analytics (OEDA) Employer Data Team. The EEOC will announce the exact date the report is due in coming weeks.

Proposed changes to the report

In November 2022, the EEOC proposed changes to the current EEO-1. Under the proposed revisions, multi-establishment filers would no longer file a separate ‘‘type’’ of report based on the number of employees at a non-headquarters establishment. Instead of filing “Type 4” for establishments with 50 or more employees and “Type 8” reports for establishments with less than 50 employees, all multi-establishment filers would simply file an ‘‘Establishment-Level Report’’ for each non-headquarters establishment regardless of the number of employees at the establishment.

This would result in the elimination of the Type 6 Establishment List Report and the renaming of some reports:

Type 2 ReportConsolidated Report
Type 3 ReportHeadquarters Report
Type 4 Report and Type 8 ReportEstablishment-Level Report
Key to remember: Employers have more time to gather and submit EEO-1 data but might see some changes to the report.
