EPA issues SNURs on certain chemical substances

EPA issued significant new use rules (SNURs) for chemical substances that were the subject of premanufacture notices. This action falls under the Toxic Substances Control Act. The SNURs require those who intend to manufacture or process any of these chemical substances for an activity that is designated as a significant new use by this rule to notify EPA at least 90 days before starting that activity. The required notification triggers EPA's evaluation of the use, under the conditions of use for that chemical substance, within the applicable review period. Individuals cannot start manufacture or processing for the significant new use until EPA has done the following:

  • Performed a review of the notice,
  • Made a suitable determination on the notice, and
  • Taken such actions required by that determination.

As a reminder, the chemical substances subject to this rule have already undergone premanufacture review. The following are some of the chemical substances impacted:

  • Carbomonocylic-oxazolidine (generic)
  • Methyl phenylethyl cyclopropanemethanol (generic)
  • Modified graphene (generic)
  • Nonane, branched

This action is not expected to have substantial direct effects on Indian Tribes. The rule is effective on May 5, 2023.
