DOL releases latest FMLA forms and notices

The federal Family and Medical Leave Act (FMLA) requires employers to give employees certain notices regarding their eligibility to take job-protected leave and whether they’ll count an absence as FMLA leave. Employers may also ask employees to give them a certification supporting the need for leave for most situations.

The U.S. Department of Labor (DOL) has models of these notices and forms, and they had an expiration date of 6/30/26. Recently, the DOL released the latest versions of those notices and forms, with a new expiration date of 8/31/29.

The forms don’t really expire. The date is an internal government check-and-balance date. The DOL has to review the documents every 3 years, even if they make no changes, and it appears this time around no changes were made.

Key to remember: The DOL published its latest FMLA notices and forms, but employers may continue to use the ones with the 6/30/26 expiration date.
