EEO is the Law posting penalty increasing

The penalty for failure to post the Equal Employment Opportunity is the Law poster will increase to $534 on March 2.

The Equal Employment Opportunity Commission published the final rule relating to the penalty increase in the Federal Register on January 31. The $9 increase is required under the Federal Civil Penalties Inflation Adjustment Act Improvements Act of 2015.

Employers covered by the Civil Rights Act of 1964 (Title VII), the Americans with Disabilities Act, and the Genetic Information Non-Discrimination Act must display the poster. In general, this is employers with 15 or more employees.

All federal agencies are required to adjust maximum civil penalties for inflation each year. Increases in posting penalties enforced by the Department of Labor were published in the Federal Register on January 18 and took effect on January 13.

When the EEO is the Law penalty increase takes effect, the maximum penalty for failure to post required federal employment law posters will be $33,486. Recent penalty increases are shown in the table below.
