Regulatory Alert: The e-Manifest User Fee Final Rule was published in the Federal Register on January 3, 2018, and is effective June 30, 2018.

The new 5-part form cannot be used until June 30.

The current 6-part form must be used through June 29 and is prohibited from use after June 29, except as provided by EPA in the following: "EPA will accept Page 1 copies of the obsolete 6-copy forms for processing after June 30, 2018, but we strongly recommend that users transition to the 5-copy forms as quickly as possible. If a user wishes to continue to use the obsolete 6-copy forms, they should undertake measures to minimize confusion in their use, such as applying a pre-printed adhesive label to the top copy with the accurate copy distribution language ('designated facility to EPA's e-Manifest system'). Facilities should train their manifest personnel to inspect manifests carefully to ensure they are routed properly during the time any of the obsolete manifests remain in use."

E-Manifest FAQs

  1. Can the old 6-ply form be used after EPA launches the e-Manifest system on June 30?
    Technically, yes. However, EPA highly recommends using the new 5-ply form. Once the new system is in place, manifests will no longer be sent to the same destinations, which has the potential for creating confusion and even lost manifests. To continue using the 6-ply manifest, you must take care to cover up the marginal words for copy distribution on the bottom of Page 1 that state "Designated facility to consignment state" (if required), and replace them with "Designated facility to EPA's e-Manifest system." See the overview section for more information.
  2. Is there a grace period once EPA launches the e-Manifest system on June 30?
    No. Although technically a generator may continue to use the old form (see question 1), the launch of the e-Manifest system makes unalterable changes to how the system works. From that date, manifest forms or data must be sent to EPA once the receiving facility receives the waste.
  3. Can the new 5-part form be used prior to June 30?
    No, the new 5-part form can be ordered prior to June 30, but it cannot be used prior to June 30.
  4. Does this make changes to the Bill of Lading (BOL)?
    No. The changes only affect the Uniform Hazardous Waste Manifest.
  5. Does an authorized state have to adopt the e-Manifest rules before using the e-Manifest system?
    No. Once launched, the e-Manifest system will take effect in all states, even if they haven't formally adopted the system.
  6. Can the e-Manifest system be used to ship hazardous and non-hazardous waste shipments together?
    Yes. The system allows a user to indicate which wastes are hazardous.
