Memo explains compliance dates for beryllium standards

Enforcement of PELs begins right away

A new OSHA memorandum confirmed that the Agency will enforce the requirements in the beryllium standard in general industry, construction, and shipyards on May 11, 2018. However, OSHA will delay enforcement of the ancillary provisions in the standard for general industry until June 25, 2018. The Agency also plans to issue a proposed rule to further delay enforcement of these provisions until December 12, 2018.

Provisions OSHA will begin enforcing right away include the permissible exposure limits in the general industry, construction, and shipyard standards; and the exposure assessment, respiratory protection, medical surveillance, and medical removal requirements in the general industry standard.

Other compliance dates in the beryllium standard remain unchanged. OSHA will enforce the general industry requirements for change rooms and showers beginning on March 11, 2019. Requirements for engineering controls will begin on March 10, 2020.

The Agency has proposed to remove the ancillary provisions from the construction and shipyard standards for beryllium and will not enforce those provisions unless it provides notice.
