FMCSA publishes civil penalty inflation adjustments

Penalty amounts will increase, but some will decrease

The Federal Motor Carrier Safety Administration (FMCSA) published an interim final rule amending the civil penalties assessed or enforced by the Agency to reflect mandated ranges which were adjusted for inflation.

The Federal Civil Penalties Inflation Adjustment Act Improvements Act of 2015 (2015 Act) established a new approach to calculating inflation adjustments. As a result, some of the penalty amounts will increase in value relative to the current codified amount, and some penalty amounts will decrease in value.

The interim rule is effective on August 1, 2016. The penalties being adjusted include out-of-service order, commercial driver’s license, recordkeeping, and subpoena violations.
