FMCSA proposes CDL, learner’s permit standards revisions
Revisions to commercial driver’s license (CDL) testing standards and new minimum standards for issuance of commercial learner’s permits (CLPs) are being proposed by the Federal Motor Carrier Safety Administration (FMCSA). The proposed regulations, published in the Federal Register, address knowledge and skills testing requirements, issuance and standards for CLPs and CDLs, and the issue of fraud prevention.
Knowledge and skills testing
This proposal would require successful completion of the knowledge test before issuance of a CLP. Currently, this is a prerequisite for issuance of the CDL. Prohibition on use of foreign language interpreters in administration of knowledge and skills tests is also proposed.
CLP and CDL standards
The proposal would require that an applicant obtain a CLP and hold it for at least 30 days before applying for a CDL. The applicant must be at least 18 years old.
Before issuing a CLP to a driver, an issuing state would be required to perform a check of the applicant’s previous driving record to ensure that the driver is not subject to any disqualification provisions found in §383.51 of the Federal Motor Carrier Safety Regulations (FMCSR).
Fraud prevention
The proposal also includes requirements that are intended to prevent and detect fraudulent testing and licensing activity in the CDL program. Proposed measures include requiring verification of Social Security Numbers (SSN), proof of legal presence in the United States, preservation of digitized driver photos by state driver licensing agencies, and background checks and formal training for all examiners.
